Spot Auto-Invest Terms

We provide Spot Auto-Invest service identified as “Auto-Invest' on the Platform, allowing you to give Bitget your Auto-Invest Instructions (as defined below) in accordance with these Terms (as defined below).

We do not make any representation or warranty that the Spot Auto-Invest service is suitable for any user or in any location. The subscription of Spot Auto-Invest may be subject to various risks, including protocol risks. Bitget does not provide any due diligence assurances on the protocols. Events such as hacks, exploits, or poor economic models that may occur at the protocol level are outside of Bitget's control. These risks may negatively impact our ability to return your Auto-Invest Assets in full or at all. You may lose the Digital Assets subscribed as they are put into smart contracts owned by Applicable Networks not operated by us.

NEITHER BITGET NOR ANY OF OUR AFFILIATES CAN GUARANTEE THE RETURN OF AUTO-INVEST ASSETS.

You are strongly encouraged to carefully review these Spot Auto-Invest Terms (“Terms”) and seek independent professional advice as to whether this product is suitable for you, taking into account your personal circumstances and objectives, financial position, and risk tolerance level.

These Terms specifically govern your access to and use of the Spot Auto-Invest service and any ancillary services made available in accordance with these Terms. By subscribing to Spot Auto-Invest service, you acknowledge and agree that you will be bound by and will comply with these Terms, as updated and amended from time to time. By accessing and/or using the Spot Auto-Invest service, you agree that you have read and understood these Terms. If you do not understand and accept these Terms in their entirety, you should not use the Spot Auto-Invest service.

These Terms are supplemental to and shall be read together with the Bitget Terms of Use (“Terms of Use”) and the provisions set out therein shall continue to apply. All terms and clauses contained in the Terms of Use (except to the extent expressly modified herein) are incorporated by reference and have the same force and effect as if set out in their entirety in these Terms. These Terms constitute Product Terms. References in the Terms of Use to the Services shall include references to these Terms contemplated hereunder.

In the event of any conflict or inconsistency between these Terms and the Terms of Use, these Terms shall prevail with respect to the services contemplated hereunder, unless expressly stated otherwise. We may make changes to these Terms (or any terms or information incorporated by reference) at any time in accordance with the Terms of Use.

1. Definitions

Unless otherwise defined, capitalised words used in these Terms shall have the same meaning given to them in the Terms of Use. The rules of interpretation set out in the Terms of Use shall apply to these Terms.

Applicable Networks means third-party networks selected by Bitget from time to time.

Auto-Invest Assets means a Digital Asset acquired by a nuser in accordance with these Terms, that is not related to or in connection with any Conversion.

Auto-Invest Currency means the currency of the Auto-Invest Asset.

Auto-Invest Date means the date and time on which a Transaction as per these Terms takes place.

Auto-Invest Plan means your Auto-Invest Instructions given in accordance with the Terms.

Fees means the fees charged by Bitget when undertaking a Transaction.

Fiat Currency means a currency or Digital Asset linked to a currency that is declared legal tender by a government.

Transaction means a transaction, and any subsequent transactions (in each case including any Conversion), undertaken by Binance in accordance with your Specified Plan.

Spot Account means the Account that a user uses for spot transactions.

2. Disclosure and Consent

2.1 By accessing and using the Spot Auto-Invest service, you acknowledge and agree that you have read, understood and accepted these Terms, and if you do not understand and accept these Terms in their entirety, you should refrain from accessing or using the Spot Auto-Invest service. For the avoidance of doubt, Auto-Invest Instructions (as defined below) continue until they are amended or canceled as per the Terms.

2.2 By accessing and using the Spot Auto-Invest service, you authorize Bitget to:

(a) undertake Transactions in accordance with your Plan;

(b) deduct Fees from your Spot Account, Funding Account, Fiat Currency, or your Eligible Earn Assets, or as otherwise set out in these terms, and to use these assets to acquire Auto-Invest Assets, in accordance with your Instructions; and/or

(c) to convert one Digital Asset into another Digital Asset or a particular Fiat currency into a Digital Asset, or vice versa, as applicable, based on supported trading pairs as available on the Platform (“Conversion”) in order to undertake Transactions on your behalf in accordance with your Plan (the “Auto-Invest Instructions”).

3. How to participate

3.1 For Transactions that do not relate to Conversions, (i) you agree to buy Digital Assets at the prices offered by Bitget on each Auto-Invest Date; (ii) you acknowledge and agree that certain prices that may not match the lowest prices available on the Exchange; (iii) if you do not have sufficient Digital Assets or Fiat Currency to complete an Auto-Invest Transaction, we will not undertake such Auto-Invest Transaction, in part or in full; and (iv) notwithstanding the above, your Auto-Invest Instructions will continue, and Bitget will attempt to complete the next scheduled Transaction in accordance with your relevant Plan.

3.2 For Transactions that relate to Conversions: (i) you agree that each Conversation will occur at the prices offered by Bitget on each Auto-Invest Date; (ii) you acknowledge and agree that the prices offered by Bitget may not be the most favorable prices that are available on the Exchange; (iii) if you do not have sufficient Digital Assets or Fiat Currency in your relevant Account to complete such Transaction, Bitget will not undertake such Transaction, in full or in part; and (iv) notwithstanding the above, your Auto-Invest Instructions will continue, and we will attempt to complete the next scheduled Transaction in accordance with your relevant Plan.

If the Platform is not accessible, or due to scheduled or emergency maintenance during the Auto-Invest cycle, your transaction will only resume when the Platform is back in service. We shall not be responsible for any change in price or difference in price that may occur during such period.

3.3 Digit Assets. In respect of Transactions that do not relate to Conversions, Digital Assets you purchase in accordance with the Terms will be transferred into your Spot Account by default; where such purchased Digital Assets are eligible (as determined by Bitget in its sole discretion), you may elect for such purchased Digital Assets to be transferred into your Earn Account. In some jurisdictions and circumstances, these Digital Assets will be transferred to your Spot Account, and will not earn any rewards. For Transactions that relate to Conversions, Assets received pursuant to a Conversion will be transferred to your Spot Account and will not earn any rewards.

4. Fees and Records

4.1 Auto-Invest Fees arise from Transactions that do not relate to Conversions are the amount shown in the Auto-Invest purchase summary and history, and are charged in Auto-Invest Currency. Bitget may change these fees from time to time, and will communicate changes by updating the purchase summary and history; and

4.2 Auto-Invest Fees arises from Auto-Invest Transactions that relate to Conversions (if any) are the amount and percentage shown in the Auto-Invest history. Bitget may change such fees from time to time.

4.3 Bitget will create a record of Digital Assets acquired in accordance with these Terms for you.

5. Auto-Invest Plan

5.1 Auto-Invest Plan that does not relate to Conversions shall contain details such as (i) the Auto-Invest Currency you have instructed Bitget to acquire; (ii) the Account that you will use to acquire Auto-Invest Assets; (iii) the frequency at which Auto-Invest Assets will be acquired; and (iv) the quantity of Auto-Invest Assets that will be acquired at each Auto-Invest Date.

5.2 Auto-Invest Plan that relates to Conversions shall contain details such as (i) details of the type and quantity of the Digital Assets or Fiat currency (each an “Asset”) to be converted and the type of Assets to be received pursuant to each such Conversion at each Auto-Invest Date; (ii) the Account used for the Conversion; and (iii) the frequency at which each Conversion will occur.

5.3 Users may cancel Auto-Invest Instructions, or amend your Auto-Invest Plan, at any time before the Auto-Invest Date. In order to do so, you must follow the instructions on the Platform.

5.4 Bitget may, upon prior reasonable notice, modify your Auto-Invest Plan due to or relating to factors such as Services upgrade, Digital Assets rebranding, and/or product feature changes.

6. Account Termination and Suspension

6.1 According to the termination clause in our Terms of Use, in the event that your Account be terminated, suspended or restricted, regardless of our obligation to notify you as required under the Terms of Use, the following events shall apply to the Spot Auto-Invest service:

(a) In case of an account suspension or restriction, the corresponding Auto-Invest plan will be put on hold, meaning no Transaction will be executed during the time that your Account is under suspension or restriction. It will not resume automatically even after the account access is restored. You will need to manually reactivate their Auto-Invest Plan following the lifting of any account suspension or restriction.

(b) In case of an account termination, the corresponding Auto-Invest Plan will be cancelled.

7. Liability

7.1 Users should also consider all the risks arising out of participating in Spot Auto-Invest service in addition to the risks as set out in the Risk Disclosure, including but not limited to:

(i) the risk that the Digital Assets subscribed may be lost because, among other things: (a) you are putting your Digital Assets into smart contracts owned by Applicable Networks and not operated by Bitget; (b) Subscribed Assets are outside of Bitget, and any of its Affiliates, control and neither Bitget or any of its Affiliates can guarantee the return of Subscribed Assets; and (c) events may occur at the protocol level which are outside our control;

(ii) the inherent risks associated with such service, including, but not limited to, the rules of the smart contract, the protocol, and the use of your Digital Assets; and

(iii) whether the Applicable Network suspends, discontinues, and terminates its business, closes down, suspends, or stops trading.

7.2 In no event will Bitget or any of its Affiliates be responsible or liable to you or any other person or entity for any direct or indirect losses (including loss of profits, business or opportunities), damages, or costs arising out of or in connection with any risk identified in these Terms. This limitation of liability is in addition to the limitation of liability contained in the Terms of Use.

7.3 Bitget or the responsible third party custodians maintain full custody of the Digital Assets and user data/information which may be turned over to governmental authorities in the event of suspension, limitation or termination arising from fraud investigations, investigations of violation of law or violation of these Terms. Bitget will not be liable to you and/or any third party for loss or damage suffered due to delay, transmission errors, technical faults or defects, breakdowns and illegal intrusion or intervention in the information provided and services offered, or any failures or delays in completing any transactions. Bitget will not be liable for any loss or damage suffered due to delays, technical faults or interruptions in the availability of the Platform, or any Services.
